1.- Ownership of the Website

In accordance with the provisions of article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (hereinafter, “LSSI”), we inform you that the website “www.phonr.com” (hereinafter, the “Website” or the “Web”) is owned by Phonr App Spain, S.L. (hereinafter, “Phonr”), with its registered office at Pozuelo de Alarcón, calle Via de las Dos Castillas número 15, letra A, 28224 VAT number B-87255295, Phone: (+34) 693 722 250, Email: datos@ysi.si.

Additionally, the website “phonr.com” has been created by Phonr, providing comparative information to users about products and services offered by telecommunications operators in the Spanish market. The domain name www.phonr.com is registered in favor of Phonr.

2.- Use of the Website

This Legal Notice (hereinafter, “Legal Notice”) establishes the conditions that regulate the use of the information society services provided by Phonr through the Website.

Thus, accessing and using the Website implies that the user (hereinafter, the “User”) fully accepts and agrees to comply with this Legal Notice, the terms and conditions, as well as the instructions or recommendations indicated in each specific case.

Access to the Website is free, except for the cost of connection through the telecommunications network provided by the User’s chosen access provider.

Phonr reserves the right to make modifications and updates to the Website and its contents, configuration, and presentation, including this Legal Notice, at any time and without prior notice. Therefore, we recommend reading it before each access and navigation on the Website.

The User undertakes not to use the Website for fraudulent purposes and not to engage in any conduct that could damage the image, interests, and rights of Phonr or third parties. The User agrees to use the Website, Services, and the included content diligently, correctly, and lawfully. In particular, the User agrees to refrain from deleting, bypassing, or manipulating the “copyright” and other identifying data of the rights holders incorporated into the content of the Website, as well as protection devices or any information mechanisms included in such content. Additionally, the User agrees not to take any action to damage, disable, or overload the Website or impede its normal use and operation in any way.

If this Legal Notice is violated or Phonr reasonably suspects a violation, it reserves the right to limit, suspend, or terminate the User’s access to the Website, taking any technical measures necessary for this purpose.

3.- User Registration

Access to the services offered by Phonr does not require User registration, allowing access to all application content and functionalities without registration.

User registration does not require acceptance of the Data Processing Policy or the Legal Notice of the Website.

4.- Intellectual and Industrial Property

Phonr holds the intellectual property rights over the arrangement of the contents of the Website (including the sui generis right over the database), its graphic design (look & feel), distinctive signs (trademarks, logos, trade names, and advertising slogans), underlying software programs (including source codes), as well as the various elements integrated into the Website (texts, graphics, photographs, videos, etc.). These rights constitute protected works under current intellectual and industrial property legislation.

The User’s use of the Website does not imply the assignment of any intellectual and/or industrial property rights over the Website, its contents, and/or Phonr’s distinctive signs. Except in cases legally permitted, the User is expressly prohibited, through this Legal Notice, from reproducing, transforming, distributing, publicly communicating, making available, extracting, and/or reusing the Website, its contents, and/or Phonr’s distinctive signs.

The reproduction of elements or contents of the Website for profit or commercial purposes is expressly and strictly prohibited.

5.- Limitation of Liability

The User acknowledges and accepts that the use of the Website is carried out at all times at their own risk and responsibility. Therefore, Phonr is not responsible for the misuse or improper use of the Website. Phonr will only be responsible for damages that the User may suffer due to our intentional actions.

In particular, Phonr will not be liable for:

• The content of linked sites through links included on the Website. The terms in section 6 of this Legal Notice will apply in this regard.
• Damages of any kind caused to the User’s computer equipment by viruses, worms, trojans, or any other harmful elements. The User acknowledges that using the Internet involves a risk that their computer equipment may be affected by the aforementioned elements. In any case, it is the User’s responsibility to have appropriate tools for detecting and eliminating harmful electronic programs.
• Damages of any kind to the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation, or interruption of the Web service. The User acknowledges that accessing the Website requires services provided by third parties beyond Phonr’s control (e.g., telecommunications network operators, access providers, etc.) whose reliability, quality, continuity, and operation are not the responsibility of Phonr.

6.- Links

The Website includes or may include links that allow the User to access other Internet pages and portals (hereinafter, “Links”). In these cases, Phonr acts as a service provider according to article 17 of the LSSI, and will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of their unlawfulness and has not duly disabled the link. If the User believes that there is a Link with illicit or inappropriate content, please notify Phonr at datos@ysi.si. This communication does not imply the obligation to remove the corresponding link.

The existence of Links does not imply that Phonr has effective knowledge or any other type of the services and contents in case of unlawfulness, nor does it necessarily mean that Phonr has agreements with the responsible parties or owners of the Links. It also does not imply that Phonr recommends, promotes, identifies, or agrees with the statements, contents, or services provided through the Links. Consequently, Phonr is not responsible for the content of the Links, nor their terms of use and confidentiality policies. The User is solely responsible for checking and accepting them each time they access and use the Links.

The User and, in general, any individual or legal entity intending to establish a link from their page or site to the Website must obtain prior written authorization from Phonr. The establishment of such a link does not imply the existence of relationships between Phonr and the owner or holder of the site or page where it is established, nor does it imply acceptance or approval by Phonr of its content or services.

In any case, Phonr reserves the right to prohibit or disable links to the Website at any time, especially in cases of unlawful activity or content on the page or site where it is included.

Phonr makes every effort to ensure that navigation through this website is carried out under the best conditions.

It is prohibited to decompile, reverse engineer, sublicense, or transmit in any way, translate or create derivative works from the computer programs necessary for the operation, access, and use of this website and the services contained therein. The Website user must refrain from deleting, altering, bypassing, or manipulating any protection devices or security systems that may be installed on it.

Phonr is not responsible for any type

of damage suffered by users due to the use of browsers or versions different from those for which this website has been designed.

8.- Applicable Law and Competent Courts

The use of the Website is governed and interpreted in accordance with Spanish law, and by using the Website, the User agrees that any conflict or dispute arising between the User and Phonr will be handled, regardless of the jurisdiction that may correspond to them, by the Courts and Tribunals of Madrid.
